Hi all.

For those that read my recent post on "too much oil" and it's possible causes, I was glad to know that at least I had garage cover with the AA. Well so I thought any way.

Couple of months back I was looking for break down cover and let's face it, we all need it at some stage.

I spoke to a AA bloke at a stand and he exchanged camper stories once I told him what I had. The deal was done when he showed me garage cover which allows me up to £500, 3 times a year cover on parts and labour. After just paying out for a new beam, I thought that will come in very handy. £20 all in for relay, home start and garage. Bargain!

Well it was until the garage fixing my recent problem, called them to claim and I was informed I've been miss sold the policy as they don't insure campers due to age.

I'm having to now write a letter to their complaints dept about my ordeal. Eventhough my break down cover clearly shows a T2 Vw camper with a 40yr old reg!!

Anyone with a better vocabulary than mine, got any good long legal baffling words of wisdom I can put in this letter. I would like to still keep the garage cover as it is a cock up on their behalf. However I'm sure there will be a get out clause somewhere.

ask for a refund and tell to go f$£$%^&**(*())(_( or summit like that .
i feel you as the rac doubled our premium this year due the fact we called em out i said well next time ill just give my premium to the first guy i meet on the street as its all the good itll do .

we now got it through the insurance money grabbin bas%$%^£&@ds

Dont take any defence about contract t&c's as a verbal contract is just as binding - especially as your proof of this being a verbally stated condition is that you took out the cover!

Wish I could get insurance for garage bills :) though insurance companies do their sums and only play it safe and cover vehicles that are less likely to break down so whilst you had confirmation incorrectly to the contrary im not surprised they wouldnt cover old vehicles

I would take the angle that they obviously have a rogue sales person deliberately praying on owners of classic vehicles to miss sell policies and would hope this wasnt a wide spread problem which a consumer society may well have had other complaints about ;)

I would respectfully ask them to honor their commitments now and and mutually agree to cancel the agreement once resolved

It sounds like a simple case of misrepresentation by the bloke who sold the package. I suggest a letter before action quoting the law and the precise circumstances of the sale.You can claim misrepresentation under the Misrepresentation Act, 1967 and at common law. It need not be fraudulent, and may be innocent. I beleive the burden of proof is on them (to prove they did not misrepresent the facts of the deal to you). Did the seller say things which induced you in to agreeing to sign up? If so, you have them.There are also other legal points you may raise.

Tread carefully as under contract law they may be able to prove that what we deem as an offer was in fact an invitation to treat. If my memory serves me correctly it may be the case that they invited you to offer to buy the policy. In which case you need to check what you were invited to offer on. If you can prove that you offered based on what was in the policy they are screwed. Does the policy explicitly exclude vehicles based on age.

In my line of work i have seen/dealt with all the big names (and just about every local small firm) an have to say by far the WORSED is the AA!
They quote some horrendous arrival times during bad weather (read two or three flakes of snow in the air)
It appears they will do anyrhing not to have to send an agent out, preferring to use their own trucks, hence the daft times! They do excel in sending the wrong vehicle out even though the customer or me have expressly told them what is waiting for them on the roadside :roll:

Green flag are by far the fastest and most efficient, well locally (durham/newcastle) anyway

Reading what the AA response was in your post, the fact they said you were "mis sold" the policy speaks volumes on liability surely?!?

is it an insurance policy? if it is, and i think it probably is, then you're covered under the Financial Services Authority and the Financial Ombudsmen Service (FOS).

it would appear that you may have been miss-sold the policy by mis-representation. if you think this is the case in the first instance complain to the AA - usually best done in writing so you can consider and include all relevant points.

points to include is the conversation with the guy who sold it to you, the policy (or other point of sale material) had campervan pictures on it etc. you'll need to check the policy wording on the policy specifically for excluded vehicles.

it's usual at this stage for the company to stick religously to the policy terms and conditions and insist their agent didn't mislead you, i.e. it's up to you to read the policy.

give them a chance to reply and deal with the complaint. if you think they don't deal with it properly and they're just dismissing your complaint based on what the policy does/does not cover and dismissing what was said to you (which is probably the stance they will take) you can confirm to them you will complain to the FOS. if you take the complaint to the FOS it will cost you nothing but cost them £500 for the FOS to review the complaint (win or lose): it's in their interest for you not to go to the FOS as it will automatically incurr this charge.

basically write to the AA, state your case, ask them for what you want (money back, claim paid etc) and if you don't get a satisfactory response you will escalate your complaint to the FOS.
 
As Bertie said, they have admitted liability with the mis-sold statement. Do you have it in writing or recored?

Push them hard on this point, request they honour the policy you were sold (and thought you were sold). Citizens advice may be able to help you, but certainly go into it with the view that you bought the policy with the cover you thought was provided.

Hi all and thanks for all your great comments.

No it's not insurance but a bolt on part of their recovery service called garage cover. It was the main reason I took out the cover because we all know how our buses like to let us down.

Well I've received a letter from member relations asking me to put in writing what has happened with supporting docs to their group risk and claim dept.

Like I've said the patrol man knew I had a bus because he gave me a story about a group of guys down south that said they had their carb stolen. The recovery guy could see a bulge in his pocket (finar finar) but asked no questions. Took them Cornwall for weeks surf then brought them back. He said the AA ask no questions because they want to uphold their reputation!

Anyway, I'll take on board what you've all said and see what my letter does with a few buts if jargon thrown in.

I'll keep you posted.
 
It doesn't help you now, but when I was looking for cover the RAC were the only ones who would cover the camper. AA and Green flag both have age restrictions.

RAC only covered the camper if I took out relay, which I wanted anyway.
 
I've been in the AA for about 15 years, and the bus is covered.
But I don't qualify for the garage cover as both my vehicles are over 10 years old.
Don't really need it anyway as this is my mate's garage......
