Anyone know if an electric window not working properly is an MOT failure?

I can answer this as I've just had my Taxi mot/safety tested, the front passenger electric window doesn't work, the car passed the mot but failed the taxi fitness test on the window, the tester told me the reason for this is because the electric windows are not part of the mot test but are required for a taxi- gutted
